Witness says man was driving aggressively before fatal crash

Aggressive drivers are more than just obnoxious; their behavior behind the wheel is downright dangerous. Recently, a witness reported that a 21-year-old man from Arlee, Montana was driving aggressively just before he was involved in a car accident that killed a woman on Evaro Hill. Worse yet, there is a possibility the man was also distracted: the witness also said the man was texting and driving before the crash.

The fatal crash happened when the man, driving a Toyota Tundra, crossed the center line. He sideswiped another pickup, struck a guardrail, and then was involved in a head-on collision with a Ford Ranger pickup. The woman who died was a passenger in the Ranger. In addition to the fatality, three people were injured in the crash and taken to a local hospital.

At the time of news report, the police accident investigation was still ongoing. The Montana Highway Patrol is asking anyone who may have witnessed the young man's driving behavior before the accident -- particularly a person who was driving behind him and probably saw the whole thing happen -- to come forward.

Officers are looking into the texting allegation. Although a witness says the man was texting before the accident, troopers don't know if he was texting at the time the accident happened. They say they are seeking that information, presumably from phone company records.

To hold another driver liable for an injury or a death sustained in a car accident, the plaintiff must prove the driver was negligent. Negligence is simply the failure to exercise the level of care a reasonable person would exercise in the same circumstances.
