Pursuing compensation for failure to diagnose cancer

Cancer is a disease dreaded by many Montana residents. Yet today, many cases of cancer can be effectively cured if the disease is diagnosed early enough, before a tumor has the chance to metastasize and spread to other parts of the body.

When a physician or other medical professional fails to diagnose cancer early enough, the results can be dire for the patient. Failure to diagnose cancer can result in spread of the disease, a worsened medical condition and a reduced chance of recovery. When the failure to diagnose is the result of medical malpractice, the patient has the right to pursue compensation through the court system.

There are many ways in which a doctor or medical worker might fail to diagnose cancer. The doctor might fail to order a biopsy or fail to properly interpret the results of a biopsy or other tests. The doctor might neglect to refer the patient to a specialist. These failures can be considered malpractice if they fall below the accepted standard of care in the doctor's specialty. Stated differently, they can result in malpractice if a reasonably competent physician in that specialty would have taken the action in question.
