Thorough investigation is critical in a car accident injury case

Car accidents are a leading cause of serious injury in Montana. When someone is injured in an auto accident caused by a negligent driver, that person has the right to bring a lawsuit and seek monetary damages.

In order to recover damages the injured victim must prove the other driver was at fault. In some cases, this is not complicated. But, other accidents require a thorough investigation in order to establish who was at fault.

The investigation often begins with a review of the police report of the accident. The police report will identify witnesses to the accident -- and witness interviews are a key part of any investigation. Tracking witnesses down and committing them to a statement can take a lot of time and legwork, but it must be done and it must be done soon, while memories are fresh and before the witnesses become hard to find.

Vehicle damage is another critical factor in the investigation. A lot can be learned about how an accident happened by carefully examining and photographing the location and severity of damage on all vehicles involved in the crash.

Likewise, the accident scene itself often yields a great deal of useful evidence. The location of skid marks, damage to roadside objects like signs and trees and the location of the vehicles right after the crash can tell a lot about how the crash occurred. Like witness interviews, documentation of vehicle damage and the accident scene must be done quickly, before the vehicles are repaired and the accident scene cleaned up.
