The Consequences Of A Failure To Diagnose

Victims of medical malpractice can suffer serious consequences and significant damages because of their medical care provider’s medical negligence. Medical negligence can include a failure to diagnose, delayed diagnosis or erroneous diagnosis and treatment which can all be devastating for victims seeking the medical care and treatment they need.

In general, medical malpractice may be to blame whenever the medical care and treatment the patient receives falls below the standard of care. The standard of care is determined by what a reasonably prudent medical care provider in the area would do. When a medical care provider has provided medical care and treatment below that standard of care, they may be considered negligent. A medically negligent medical care provider may then be liable for the damages suffered by the victim.

A victim of medical malpractice may be able to recover compensation for their physical, financial and emotional damages that result. In general, if a failure to diagnose, delayed diagnosis or erroneous diagnosis or treatment resulted in a worsened condition beyond what would have been expected had the medical condition been timely, and properly, diagnosed and treated, then the medical care provider may be responsible to compensate the victim for their damages. A variety of medical care providers may be liable for medical malpractice damages including doctors, nurses and even hospitals.

It is the responsibility of a medical care provider or hospital to keep the patient safe and to provide them with the treatment and care they need. When they fail to do so, it is important for victims of medical malpractice and their families to be familiar with the legal protections and remedies available to them.
