The middle of the night can be a dangerous time on Montana roads. Too many drivers are impaired by fatigue or intoxication during those hours. Whether these factors were behind a car accident that killed three young men on Highway 87 in Cascade County recently is not known at this time. But the accident happened sometime around 3 a.m., so it is a real possibility.
Two of the victims, both 25 years old and from Great Falls, were in a pickup that hit a guardrail. The truck went over the center line and was involved in a head-on collision with a car driven by a 27-year-old man from Anaconda. Police say none of the men was wearing a seat belt, and the two victims in the pickup were ejected from the vehicle.
If the family of any of the victims hires an attorney to evaluate the possibility of a claim, that attorney will carefully review any official accident investigation and may hire an accident reconstruction expert of his or her own. If it is determined that the accident was caused by a negligent driver, the families of the victims right to bring a wrongful death claims and recover damages.
When a negligent driver dies in the crash, the victims can still bring their claims against the deceased driver’s estate, and the deceased driver’s insurance company will be obligated to pay any damages up to the policy limits. In a wrongful death case, the family will be entitled to compensation for loss of support and loss of companionship, as well as medical and funeral expenses.
