Woman Dies In Fatal Car Accident In Billings Roundabout

For family members, the sudden loss of a loved one in an automobile accident can be devastating. Although no amount of money can compensate for a wrongful death, obtaining a recovery against a negligent driver may help with expenses and, in some instances, provide a degree of closure.

A woman from Billings was recently killed when her vehicle was struck by an SUV at the roundabout at Grand Avenue and Shiloh Road in west Billings. Police say the SUV driver entered the roundabout traveling in the wrong direction.

According to the Montana Department of Transportation, there were 189 fatalities on Montana roadways in 2010. Numerous other car accidents resulted in serious injury. Many of these accidents were likely caused by negligent driving.

Under Montana’s wrongful death statute, surviving family members are entitled to bring a lawsuit for damages they have suffered due to the death of a loved one caused by a negligent driver. Under the statute, family members can sue for both economic damages, such as loss of the income the deceased person would have provided, and non-economic loss, such as loss of love, companionship and affection. Funeral expenses are also recoverable.

An experienced personal injury attorney can guide grieving family members through the intricacies of a wrongful death lawsuit. An investigation of the accident and those involved can help establish liability and identify the various sources of insurance and other funds that may be available for compensation. The survivors of a tragic accident should never be alone as they seek financial compensation for the loss of a loved one.
